Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.
The case originates in a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his return to the United States to face human smuggling charges, he was detained in federal custody.
In her order, the judge noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal challenge center on conflicting claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.
